A Will is the legal document that sets out who should receive your estate, who should administer it, and how your wishes should be carried out after death.
While some Wills are straightforward, others require careful consideration of the type of gifts being made, the people appointed, beneficiary circumstances, tax consequences, protective structures or the risk of future disputes.
Estate planning also includes appointing trusted people to make financial and legal decisions on your behalf if you lose capacity, commonly known as appointing an enduring Power of Attorney. Similarly, an appointment of Enduring Guardian can allow someone to make personal, lifestyle and health decisions if you are living but unable to do so yourself.
Inhera Legal advises on estate plans ranging from simple arrangements through to more complex and tailored structures, with recommendations based on what is appropriate for your circumstances.
We assist with:
simple and complex Wills
testamentary trust Wills
special disability trust Wills
general and enduring powers of attorney
appointments of enduring guardian
codicils and replacement Wills following major life changes
revocation and replacement of existing incapacity documents
statements of wishes
signing, capacity and execution considerations

When someone dies, the executor is responsible for identifying estate assets, applying for Probate where required, paying debts and expenses, dealing with administration issues and distributing the estate to the beneficiaries.
Probate is the Court process that confirms the validity of the Will and the executor’s authority to administer the estate. Not every estate requires Probate, but where it is needed, the process must be handled carefully.
Inhera Legal assists executors with probate applications and estate administration, from the initial review through to practical guidance on next steps.
Where there is no Will, or the named executor is unable to act, we assist beneficiaries in obtaining a grant of Letters of Administration so they can deal with the estate.
We assist with:
applications for Probate
Letters of Administration
reseals of interstate or overseas grants
executor advice and duties
transmission or transfer of estate assets
beneficiary communications

Deceased estate matters can involve legal, financial and family issues at the same time. Executors, beneficiaries and family members may need advice about what a Will means, whether an estate is being properly administered, whether information should be provided, or how to resolve uncertainty before it escalates.
Inhera Legal provides advice on deceased estate issues with a focus on clarity, strategy and proportionate resolution. Not every estate issue needs to become litigation. Often, the first step is understanding the legal position, the practical risks and the options available.
We assist with:
advice for executors
advice for beneficiaries
concerns about delay or lack of information
questions about executor conduct
interpretation of Will clauses
informal estate negotiations
related-party estate issues
family provision considerations
estate administration concerns
referrals to counsel or litigation specialists where needed

Superannuation does not automatically form part of a person’s estate. What happens to superannuation after death depends on the fund rules, any death benefit nomination, trustee discretion and how the broader estate plan has been structured.
For many clients, superannuation is one of the most significant assets connected to their estate planning. It can also be one of the most misunderstood.
Inhera Legal advises on how superannuation death benefits interact with Wills, estate planning, beneficiaries and family circumstances.
We assist with:
binding death benefit nominations
non-binding death benefit nominations
coordination between superannuation and the Will
review of existing nomination arrangements
advice following the death of a fund member

Some estate matters require a deeper level of advice. This may be because of the value or structure of the assets, family dynamics, trusts or companies, business ownership, tax considerations, overseas connections or the need to plan for control across generations.
Inhera Legal works with families, business owners, professional advisers and organisations on estate and succession matters where legal advice needs to sit alongside tax, asset structuring, governance and family decision-making.
We assist with:
blended family estate planning
business owner succession planning
family trust and company control issues
asset-structure considerations
overseas assets and cross-border estate issues
planning for vulnerable or dependent beneficiaries
succession planning for family groups
complex beneficiary arrangements
estate planning where dispute risk is elevated
